These Terms of Service ("Terms") govern your access to and use of the Wilow website at trywilow.com and our advertising analytics and creative platform (collectively, the "Service"), operated by TripleDouble Group Ltd (company number: 13609173), trading as Wilow ("we" or "us"). By accessing or using the Service, you agree to these Terms. These Terms incorporate our Privacy Policy at trywilow.com/privacy.
Wilow is an advertising analytics and creative platform that connects with third-party digital advertising platforms (currently Meta, including Facebook and Instagram) to provide business leaders with actionable visibility into their advertising performance. The Service retrieves, organises, and visually presents your ad creative metrics, audience information, and ad status information, and uses artificial intelligence to label and analyse advertising creative.
Where we make them available to you, the Service also includes features that generate new advertising creative from material you supply, and we may separately agree to produce advertising creative for you as a service. Section 4 governs both.
The Service is designed for informational, analytical and creative purposes only. Wilow does not run, manage, or optimise advertising campaigns on your behalf, and does not review, approve or publish any advertising you create. We reserve the right to modify, update, suspend, or discontinue the Service at any time, with or without notice.
To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to maintain and promptly update your account information. You agree to maintain the security and confidentiality of your login credentials and not share your account with others. You accept responsibility for all activities that occur under your account. You agree to notify us immediately at support@trywilow.com of any unauthorised use of your account. You must be at least 18 years old to create an account and use the Service.
The Service allows you to connect your third-party advertising accounts, currently limited to Meta (Facebook/Instagram). By connecting these accounts, you authorise Wilow to access your advertising data through Meta's Marketing API. You represent and warrant that you have the authority to grant Wilow access to the advertising accounts you connect and that doing so does not violate any agreements you have with Meta or any third party. Wilow is not responsible for the accuracy, completeness, or availability of data provided by Meta or any other third-party advertising platform. You may disconnect your Meta advertising account at any time through your account settings.
What this covers. This section applies whenever creative is generated from material you supply, whether you do it yourself using generation features we have made available to you, or we produce creative for you as a service under a separate arrangement. Generation uses artificial intelligence models operated by third parties. Not every plan or account has access to generation features, and we may add, change or withdraw them at any time.
"Uploads" means anything you upload, submit, paste, link or otherwise supply to us for this purpose, including product photographs, brand assets, existing advertisements and any material you supply as a stylistic or structural reference. "Output" means the images and other material generated in response.
Your rights in Uploads. You represent and warrant that, for every Upload, you own it or hold all rights, licences, consents and permissions necessary to supply it to the Service and to have it processed as described in these Terms, and that neither the Upload nor its use in accordance with these Terms infringes or misappropriates any copyright, trademark, trade dress, design right, patent, right of publicity, moral right, privacy right or other right of any person. This warranty applies to every Upload without exception, including any material that originates with a third party and any material you supply as a reference. Where an Upload contains a recognisable person, you further warrant that you hold every consent required for its use in advertising.
Reference material. Where the Service invites you to supply reference material to guide the style, structure or art direction of generated creative, you remain solely responsible for determining that your supply and use of that material is lawful. Nothing in the Service, in its interface, or in any guidance we publish is a representation by us that any particular Upload is lawful for you to use, and no feature of the Service should be read as legal advice or as our approval of your Uploads.
How Uploads are processed. To generate Output, Uploads are transmitted to and processed by third-party artificial intelligence providers and their infrastructure suppliers, which may be located outside the United Kingdom. Those providers process Uploads under their own terms, which we do not control and which may permit them to retain or use content submitted to them. You should not upload anything you are not willing to have transmitted to a third-party provider on that basis. Our Privacy Policy at trywilow.com/privacy describes this processing further.
Output. As between you and us, and to the extent we hold any rights in it, we assign to you our rights in the Output generated from your Uploads, so that you may use it for your advertising. We do not warrant, and cannot warrant, that Output is original, that it is free of the rights of any third party, or that your use of it will not give rise to a claim. Artificial intelligence models generate Output in response to inputs from many users, and Output that is similar or identical to Output generated for another user may be produced. Output may also be inaccurate, may misrender text, product detail or brand marks, and must be reviewed by you before use.
What you publish is yours. You are solely responsible for every advertisement you publish, wherever you publish it, including its compliance with the advertising policies, generative-AI terms and disclosure requirements of the platform you publish it on, and with all applicable advertising, consumer protection and intellectual property law. You are responsible for reviewing Output for accuracy and for any resemblance to a third party's brand, product, trade dress or creative before you publish it.
Free Plan. The Free plan requires no payment details and has no trial period. It provides access to every feature of the Service, with up to three connected Meta ad accounts and the most recent 30 days of data. We reserve the right to modify or discontinue the Free plan at any time.
Pro Plan ($50 per month). Access to the Service with up to ten connected Meta ad accounts and the most recent 12 months of data. Current pricing is always shown at trywilow.com/pricing and at checkout, and that price governs.
Other plans. Additional tiers may be described on our website as planned or in development. A plan is not available to you until it can be purchased through the Service, and any price indicated for a plan that is not yet available is indicative only.
Credits. Some actions on the Service, including generating creative, consume credits. Where we make credits available to you, the following applies.
Included credits. Each plan includes an allowance of credits that refreshes at the start of each billing month. Unused plan credits do not carry over and have no value once that month has ended.
Purchased credits. You may also buy additional credits in packs. Purchased credits do not expire for as long as your account remains open. Where you hold both, credits are drawn from your monthly plan allowance first, and from purchased credits only once that allowance is exhausted.
What credits are not. Credits have no cash value. They are not currency, not a stored-value instrument and not a deposit; they cannot be transferred between accounts, sold, or exchanged for money, and they are non-refundable except where a refund is required by law. Credits belong to the account that acquired them. If you close your account, or if we suspend or terminate it under section 12 for breach of these Terms, any remaining credits, including purchased credits, are forfeited.
What credits buy. The credit cost of an action is shown to you before you confirm it. Credits are consumed by the act of performing the action, not by whether you are happy with what it produces. If a generation completes and you do not like the creative, the credits are still consumed. Where a generation fails for technical reasons and produces nothing, we return the credits it consumed.
Changes to credits. We may change the number of credits a given action consumes, the number of credits included with a plan, and the number of credits sold in a pack, on reasonable notice given through the Service or by email. Such changes are never applied retrospectively to credits already consumed. If a change materially reduces the value of purchased credits you already hold, contact us at support@trywilow.com and we will offer either a pro-rata refund of the unused portion at the price you paid or an equivalent top-up of credits.
Payment. Payment is processed through Polar. By subscribing to a paid plan, you authorise us to charge your designated payment method on a recurring monthly basis. You are responsible for keeping your payment information up to date. If payment fails, we may suspend access to paid features until the outstanding balance is resolved.
Cancellation. You may cancel your subscription at any time through your account settings or by emailing support@trywilow.com. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds or credits will be issued for partially used billing periods.
You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations. You agree not to: violate any applicable law or third-party right including Meta's Platform Terms; upload any material you do not have the rights to supply; use the Service to produce advertising that is likely to confuse people about the source, sponsorship or affiliation of goods or services, or that passes off your goods or services as another's; attempt to gain unauthorised access to the Service; reverse engineer, decompile, or disassemble any part of the Service; reproduce or exploit any portion of the Service without express written permission; use the Service for illegal or unauthorised means; or use data obtained through the Service to build a competing product.
Our Intellectual Property. The Service, including its design, user interface, features, functionality, content, trademarks, the Wilow name and logo, and all underlying technology, is owned by TripleDouble Group Ltd and protected by copyright, trademark, and other intellectual property laws.
Your Data and Uploads. You retain all rights to the advertising data, Uploads and other content you provide to or access through the Service. By using the Service, you grant Wilow a limited, non-exclusive, worldwide, royalty-free licence to access, process, store, transmit, reproduce and display that data and those Uploads, and to transmit them to the third-party providers described in section 4, solely for the purpose of providing the Service to you.
Feedback. If you provide us with suggestions, ideas, or bug reports regarding the Service, you grant us a non-exclusive, irrevocable, perpetual, worldwide, royalty-free licence to use and incorporate such feedback into the Service without any obligation or compensation to you.
We respect the confidentiality of your advertising data and business information. We will not disclose your data to any third party except as described in our Privacy Policy at trywilow.com/privacy, as necessary to provide the Service including the processing described in section 4, as required by law, or as you instruct. We do not sell, rent, or trade your advertising data for any purpose other than providing the Service.
The Service integrates with third-party advertising platforms (currently Meta), third-party artificial intelligence providers, and other third-party service providers (such as Polar for payment processing). Your use of these third-party services is subject to their respective terms and conditions and privacy policies. We are not responsible for the content, availability, or accuracy of any third-party service, and we do not pass through to you any indemnity, warranty or other protection those providers may or may not offer us.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. The Service is designed to provide insights for analytics and should not be relied upon as a definitive record of advertising performance.
WITHOUT LIMITING THE ABOVE, WE MAKE NO WARRANTY OF ANY KIND IN RESPECT OF OUTPUT. WE DO NOT WARRANT THAT OUTPUT IS ORIGINAL, ACCURATE, FIT FOR ANY PURPOSE, OR FREE FROM THE COPYRIGHT, TRADEMARK, TRADE DRESS, PUBLICITY OR OTHER RIGHTS OF ANY THIRD PARTY, AND WE HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OR PUBLICATION OF OUTPUT, INCLUDING ANY CLAIM THAT OUTPUT INFRINGES OR VIOLATES THE RIGHTS OF ANY PERSON.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRIPLEDOUBLE GROUP LTD, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO TRIPLEDOUBLE GROUP LTD DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR £100, WHICHEVER IS GREATER. NOTHING IN THESE TERMS SHALL LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE OR FRAUD.
You agree to indemnify, defend, and hold harmless TripleDouble Group Ltd and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or in connection with:
(a) any third-party claim that your Uploads, or your use or publication of Output, infringes or misappropriates that party's copyright, trademark, trade dress, design right, patent, right of publicity, moral right, privacy right or other right;
(b) any advertising you publish, including its compliance with the policies of the platform you publish it on and with applicable advertising, consumer protection and intellectual property law;
(c) your use of the Service, or your breach of these Terms or of any applicable law; and
(d) your connection of third-party advertising accounts to the Service without proper authorisation.
We provide no indemnification to you under these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including where we receive a credible allegation that your Uploads or your published advertising infringe a third party's rights. You may terminate your account at any time by contacting support@trywilow.com or through your account settings. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitation of liability.
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, the parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
Entire Agreement. These Terms, together with the Privacy Policy at trywilow.com/privacy, constitute the entire agreement between you and TripleDouble Group Ltd regarding the Service.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited to the minimum extent necessary, and the remaining provisions shall remain in full force.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure. We shall not be liable for any failure or delay in performing our obligations where such failure results from circumstances beyond our reasonable control.
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms at trywilow.com/terms-of-service and updating the "Last Updated" date above. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
